ANOUNCEMENT

The Judicial Council of the Republic of North Macedonia at the 502nd session held on 16.10.2024 (Wednesday) amended and supplemented the agenda and decided on the following:

1. Adopted the minutes of the 496th session of the Judicial Council of the Republic of North Macedonia dated August 26, 2024, with remarks and

- adopted the minutes of the 497th emergency session of the Judicial Council of the RSM from September 5, 2024, without comments;

2. Determined the termination of the judicial function due to fulfillment of conditions for old-age pension of Jovanka Spirovska Paneva, judge of the Basic Civil Court Skopje;

3. Marija Ivanovska, Gotse Ristevski and Dejan Nestorovski were elected as lay judges of the Basic Criminal Court Skopje;

- It was determined that Zoran Dimishkov, a lay judge of the Skopje Court of Appeal, has been dismissed, at his request;

4. Established a Commission for checking the fulfillment of the conditions and criteria for the election of the president of the Basic Court of Kavadarci, consisting of: Antoaneta Dimovska, M.Sc. - president of the Commission and Jeneta Bektović and Miljazim Mustafa, M.Sc., members of the Commission:

5. Reviewed and adopted the Report on the results of testing of the knowledge of practical work with computers;

6. Discussed the request, i.e. the consent for the temporary assignment of judge Ilyaz Ismaili to perform judicial function in another court and made a decision by which Ilyaz Ismaili, judge of the Basic Court of Gostivar was temporarily referred to perform the judicial function in the Basic Court of Kicevo, considered from 16.10.2024, for a period of one year from the day of the referral;

7. Discussed the submitted appeals on ranking lists of candidates for the selection of judges in the higher court for the Stip Court of Appeal and the Gostivar Court of Appeal and made the following decisions:

- the appeal of Aleksandra Palashevska-judge of the Basic Civil Court Skopje against the proposal of a ranked list of candidates for the election of one judge of the Appellate Court Shtip, for the civil district, is partially adopted;

- The ranking list of candidates for the election of one judge of the Stip Court of Appeal for the civil district remains unchanged.

- the appeal of Aleksandra Palashevska-judge of the Basic Civil Court of Skopje against the proposed ranking list of candidates for the election of two judges of the Appellate Court of Gostivar, for the civil district, is partially accepted;

- the appeal of Ilir Iseni, judge of the Basic Court of Debar against the proposed ranking list of candidates for the election of two judges of the Appellate Court of Gostivar, for the civil district, is partially accepted;

- the appeal of Jehona Sadiku, judge of the Basic Civil Court of Skopje, filed against the proposed ranking list of candidates for the election of two judges of the Appellate Court of Gostivar, for the civil district, is partially accepted;

- The ranking list of candidates for the election of two judges of the Gostivar Court of Appeal, for the civil district, was adopted;

8. Discussed an objection from candidate Nikola Krsteski - judge of the Bitola Court of Appeals against a decision about improper documentation after a published announcement for the election of the president of the Bitola Court of Appeals and made a decision rejecting the objection as inadmissible;

9. Discussed the Report of the Commission for Decisions on Objections for the Regular Evaluation of Judges and Presidents of Courts for the period 2019-2022 and it was adopted, after which it was determined that decisions should be drawn up according to the report;

10. Discussed reports of the Commissions for checking the fulfillment of the conditions and criteria for the selection of presidents of the Higher Administrative Court, Basic Court Berovo, Basic Court Delčevo, Basic Court Kruševo, Basic Court Ohrid, Basic Court Radovish, Basic Court Strumica and Basic Court Gevgelija also adopted them, so it was established that the application of the candidate for the election of the president of the Basic Court of Strumica is complete;

- Made a decision to publish an advertisement for the election of presidents of the Basic Court Berovo, Basic Court Delčevo, Basic Court Krushevo, Basic Court Radovish and Basic Court Ohrid,

-Formed a Commission for checking the fulfillment of the conditions and criteria for the selection of presidents of the above-mentioned courts, consisting of: Pavlina Crvenkovska - president of the Commission and Janeta Bektović and Hanif Zendeli - members of the Commission;

11. Decided on the requests submitted by a judge for the exclusion of the public in proceedings initiated to determine the responsibility of a judge/president of the court, which on his previous requests were made decisions for the public of the entire course of the proceedings and made decisions approving the requests for exclusion to the public in the further course of the proceedings;

12. Deliberated on the reports of the Commissions on the ascertained situation after submitted requests for determining the responsibility of the judge/president of the court and made decisions:

- on a request to determine the responsibility of a judge/president of a court, the Council made a decision to dismiss him from exercising his judicial function for violation of Article 74, paragraph 1, paragraph 2 of the Law on Courts, c.v. with Article 76 paragraph 1 point 7 of the same law. At the same time, the Council made a decision on the temporary removal of the judge from exercising his judicial function until the final completion of the procedure for determining the judge's responsibility;

- the hearing on a Report on the ascertained situation after a submitted request for determining the responsibility of a judge/president of the court was postponed until the final conclusion of the procedure for determining the responsibility of the judge for whom a decision was made to dismiss him from exercising the judicial function;

- on a request to determine the responsibility of a judge/president of the court, the Council made a decision to stop the procedure;

- on a request to determine the responsibility of a judge/president of the court, the Council made a decision imposing a disciplinary measure on the judge, a salary reduction in the amount of 30% of the judge's monthly salary for a period of 6 (six) months for a disciplinary violation committed after Art. 74 paragraph 1 paragraph 2, paragraph 3 paragraph 1 of the Law on Courts, c.v. with article 76 paragraph 1 point 4 of the same law.

- on one request to determine the responsibility of a judge/president of the court, the Council made a decision to stop the procedure;

13. Decided on two reports of the Commissions on established factual situation after submitted requests for determining the responsibility of a judge/president of the court and made decisions to continue the proceedings and

14. Formed Commissions of reporters on submitted requests to determine the responsibility of a judge/president of a court, whereby one request for responsibility of a judge/president of a court was withdrawn due to a determined termination of the judge's judicial function due to fulfillment of conditions for an old-age pension, for which will be notified to the applicant.
